Terms of Service

To access certain features of NomadicCreators.com, you must register for an account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate.

You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorized use of your account.

You must be at least 18 years of age to create an account and use the platform.

"Independent Subcontractors" (including contracted media personnel) refers to any third-party media production talent—including but not limited to contracted photographers, videographers, drone operators, audio engineers, and field production crew—retained by Nomadic Creators on an independent project, jobsite, or event basis.

All Independent Subcontractors (including contracted media personnel) are engaged as independent contractors under IRS 1099 classification, not as employees, agents, or partners of Nomadic Creators. Each Independent Subcontractor is solely responsible for their own taxes, insurance, licenses, equipment, and compliance with applicable federal, state, and local laws.

Nothing in these Terms of Service creates an employer-employee relationship, joint venture, partnership, or agency between Nomadic Creators and any Independent Subcontractor (including contracted media personnel).

NomadicCreators.com supports two primary user roles: Independent Subcontractors (including contracted media personnel) and Brands.

Independent Subcontractors (including contracted media personnel) are third-party media production talent — outdoor adventurers, overlanders, and media creators — who build profiles, showcase portfolios, and apply for or accept content production contracts from Brands.

Brands are corporate entities, commercial businesses, marketing organizations, equipment manufacturers, or product makers seeking authentic user-generated field content, product testing, or commercial media assets. Brands post campaign briefs, review Independent Subcontractor applications, and commission content deliverables or licensing agreements.

Both roles agree to conduct themselves professionally and in good faith. Misrepresentation of identity, credentials, or capabilities may result in account suspension or termination.

All media assets—including photos, video footage, raw files, audio recordings, b-roll, written dispatches, and production deliverables—captured or created by Independent Subcontractors (including contracted media personnel) on behalf of Nomadic Creators projects are executed on a strict Work-for-Hire basis.

Transfer of Rights: Nomadic Creators retains full, exclusive copyright, title, and ownership of all original and raw assets upon financial settlement. Independent Subcontractors hereby assign and transfer all intellectual property, distribution, commercial, and licensing rights exclusively to Nomadic Creators.

Limited Portfolio Usage: Independent Subcontractors shall not publish, license, sell, or distribute project media to third parties. Any non-commercial portfolio or self-promotional use by the Independent Subcontractor must be expressly authorized in writing by Nomadic Creators and remains subject to client non-disclosure and embargo agreements.

NomadicCreators.com is provided on an "as is" and "as available" basis. We make no warranties, express or implied, regarding the operation of the platform or the accuracy, reliability, or completeness of any content.

To the fullest extent permitted by law, Nomadic Creators shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of, or inability to use, the platform.

We are not a party to any agreement entered into between Independent Subcontractors (including contracted media personnel) and Brands. We do not guarantee the performance, quality, or timeliness of any contracted work, and we are not liable for any disputes arising between users regarding deliverables, payment, or conduct.

Independent Subcontractors (including contracted media personnel) assume full responsibility for their own on-site safety, jobsite compliance, and liability while performing contracted services, and acknowledge that they are engaged as 1099 independent contractors. Nomadic Creators is not liable for the acts, omissions, equipment, or safety practices of any Independent Subcontractor.

You agree to hold Nomadic Creators harmless from any claims arising out of or related to your use of the platform or your interactions with other users, including claims arising from the conduct, safety, or deliverables of Independent Subcontractors (including contracted media personnel).

You may deactivate your account at any time by contacting us or through your account settings.

NomadicCreators.com reserves the right to suspend or terminate your account at our sole discretion, without prior notice, if we believe you have violated these Terms of Service or engaged in conduct harmful to the platform or its users.

Upon termination, your right to access and use the platform ceases immediately. Any content you have uploaded may be removed from the platform following termination.

Provisions that by their nature should survive termination — including Definitions & Independent Subcontractor Status, Content Ownership, and any dispute resolution clauses — shall remain in effect after account closure.
