Nomadic Creators LLC is a single-operator field production studio, owned and operated exclusively by James Drummond. NomadicCreators.com is the studio's public website and client engagement portal.

Nomadic Creators LLC is not an agency, directory, employer platform, labor broker, marketplace, or intermediary of any kind. It does not connect third parties, represent talent rosters, or facilitate transactions between independent creators and clients.

100% of User-Generated Content (UGC), brand testing, field reviews, and solo media captures are captured entirely in-house by one person: James Drummond, the sole owner-operator of the studio.

These Terms of Service govern your use of the NomadicCreators.com website and the commissioning of production services directly from Nomadic Creators LLC.

To access certain features of NomadicCreators.com, you may register for an account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate.

You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorized use of your account.

You must be at least 18 years of age to create an account and use the website.

"Clients" (also "Brands") refers to corporate entities, product manufacturers, marketing organizations, event organizers, and campaign coordinators who commission field capture, user-generated content (UGC), or commercial media assets directly from Nomadic Creators LLC.

All commissioned work is governed by an explicit Statement of Work (SOW) and/or a Master Service Agreement (MSA) executed directly between the Client and Nomadic Creators LLC. Scope, deliverables, timelines, usage rights, and pricing are defined exclusively within those executed agreements, which control in the event of any conflict with these Terms.

Project Lifecycle: Engagements typically progress from inbound inquiry and scoping, through proposal and agreement execution (including any required deposits or retainers), into pre-production, field capture, post-production, and final delivery. Each stage is managed directly by Nomadic Creators LLC.

Clients agree to conduct themselves professionally and in good faith. Misrepresentation of identity, credentials, or intent may result in suspension or termination of an engagement or account.

UGC and Brand Partnership engagements — including product testing, field reviews, authentic user-generated content, and solo brand activations — are 100% single-creator operations.

Zero third-party hires, contractors, or external crew are involved in any UGC or Brand Partnership project. All capture, production, editing, and delivery is performed personally by James Drummond.

Commercial media and event production engagements are likewise led, captured, edited, and managed entirely in-house by James Drummond, using studio-owned equipment and safety protocols.

For large commercial event coverage only, Nomadic Creators LLC reserves the right to engage secondary technical support — such as a second camera operator or an FAA Part 107 drone pilot — on a strictly temporary, per-project basis.

Any such engagement is project-specific and arises solely from the scale requirements of large event coverage; there is no ongoing contractor pool, staffing bench, or routine secondary hiring practice.

On the rare occasions when temporary technical support is engaged for a commercial shoot, those individuals act under James Drummond's direct on-site creative direction and project safety guidelines for the duration of the assignment only.

All contingent support personnel and external crew operate strictly as independent contractors and are NOT covered under Nomadic Creators LLC's insurance policies. Every external contractor must maintain their own independent commercial general liability insurance (and FAA drone liability insurance where applicable) and provide a valid Certificate of Insurance (COI) naming Nomadic Creators LLC as an additional insured prior to performing any work or stepping onto any project jobsite.

Each contingent support engagement is governed by a project-specific written agreement executed directly between Nomadic Creators LLC and the individual. Contingent support personnel are never self-serve participants, are not engaged through any signup or job-acceptance mechanism on NomadicCreators.com, and are never independently matched with clients. Nomadic Creators LLC is not an agency, directory, employer platform, or labor broker, and no such platform functionality exists on this website.

All media deliverables — including photos, video footage, raw files, audio recordings, b-roll, written dispatches, and production assets — created by Nomadic Creators LLC in connection with a Client project are produced on a work-for-hire basis.

Transfer of Rights: Upon final financial settlement of the applicable SOW/MSA, all right, title, and interest in the delivered media assets — including intellectual property, distribution, commercial, and licensing rights — transfers exclusively to the Client, to the extent and on the timeline specified in the executed agreement.

Limited Retained Rights: Nomadic Creators LLC retains a limited, non-commercial right to display completed work for self-promotion and portfolio purposes, subject to any Client non-disclosure obligations and embargo timelines specified in the executed agreement.

Raw assets, work-in-progress materials, and undelivered files remain the property of Nomadic Creators LLC until expressly delivered and transferred under the terms of the applicable agreement.

Nomadic Creators LLC maintains full operational control, equipment ownership, and safety protocols for all in-house field operations and production sites, including jobsite compliance, drone operations (in accordance with FAA Part 107 requirements), and on-location risk management.

NomadicCreators.com is provided on an "as is" and "as available" basis. We make no warranties, express or implied, regarding the operation of the website or the accuracy, reliability, or completeness of any content, except as expressly stated in an executed SOW/MSA.

To the fullest extent permitted by law, Nomadic Creators LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of, or inability to use, the website. Nothing in these Terms limits liability allocated to Nomadic Creators LLC under an executed SOW/MSA.

You agree to hold Nomadic Creators LLC harmless from any claims arising out of or related to your misuse of the website or your breach of these Terms or any executed agreement.

You may deactivate your account at any time by contacting us or through your account settings.

NomadicCreators.com reserves the right to suspend or terminate your account at our sole discretion, without prior notice, if we believe you have violated these Terms of Service or engaged in conduct harmful to the studio or its clients.

Upon termination, your right to access and use the website ceases immediately. Obligations under any executed SOW/MSA — including payment and confidentiality — survive account closure.

Provisions that by their nature should survive termination — including Business Structure & Operator Identity, Intellectual Property & Work-for-Hire, and any dispute resolution clauses — shall remain in effect after account closure.
